- Overview
My Lyra Song creates personalized digital songs and optional personal-use video add-ons based on the stories, details, photos, and other materials submitted by customers in connection with an order.
These materials may include names, nicknames, personal stories, family memories, romantic details, dates, locations, photos, images, personality details, written instructions, and other information used to personalize a song or related deliverable.
You are solely responsible for everything you submit.
- Customer Responsibility
You represent and warrant that you have the full legal right, authority, permission, and consent to submit all materials you provide to My Lyra Song.
This includes permission to submit:
a. names;
b. nicknames;
c. personal stories;
d. private memories;
e. photos;
f. images;
g. likenesses;
h. relationship details;
i. family details;
j. recipient information;
k. information about minors;
l. copyrighted or third-party materials;
m. any other content included in your order.
We are not responsible for verifying whether you have obtained all required rights, permissions, consents, releases, or approvals.
- Rights You Grant to My Lyra Song
By submitting materials, you grant My Lyra Song and its service providers a worldwide, non-exclusive, royalty-free license to use, reproduce, process, store, transmit, modify, adapt, edit, format, and otherwise use those materials as reasonably necessary to:
a. review your order;
b. create your personalized song;
c. create any optional video add-on;
d. communicate with you;
e. deliver the final files;
f. provide customer support;
g. maintain business records;
h. resolve disputes;
i. enforce our policies;
j. comply with legal obligations;
k. protect the rights, safety, and security of My Lyra Song, customers, recipients, service providers, and others.
This license does not transfer ownership of your original submitted materials to us. It allows us to use the materials as needed to provide the Service.
- Photos and Images
If you submit photos or images, you represent and warrant that:
a. you own the photos or have permission to use them;
b. you have permission from all identifiable people shown in the photos;
c. if any person shown is a minor, you are the parent, legal guardian, or otherwise have all required authority and consent;
d. the photos do not violate any copyright, privacy right, publicity right, trademark right, confidentiality obligation, platform rule, or other third-party right;
e. the photos are not unlawful, abusive, explicit, exploitative, defamatory, harassing, or otherwise inappropriate.
Do not submit professional photos, copyrighted images, screenshots, social media images, stock photos, celebrity images, artwork, or third-party content unless you have the legal right to do so.
- Minors
Do not submit photos, names, stories, likenesses, or personal details of a minor unless you are the parent, legal guardian, or otherwise have all required legal authority and permissions.
By submitting any materials involving a minor, you represent and warrant that you have the right to do so and that your submission is lawful and appropriate.
We reserve the right to reject or remove any material involving minors if we believe it is inappropriate, unsafe, unclear, or inconsistent with our policies.
- Privacy of Other People
Your order may include information about recipients, family members, friends, romantic partners, spouses, children, parents, deceased loved ones, or other people.
You are responsible for ensuring that you have the right to submit private or personal information about those people.
Do not submit private, sensitive, embarrassing, confidential, intimate, medical, financial, legal, or highly personal information about another person unless you have the right and authority to do so.
We are not responsible for disputes between you and any person referenced in your order.
- Sensitive Information
You should avoid submitting unnecessary sensitive information.
Sensitive information may include health information, mental health information, religious beliefs, political opinions, sexual orientation, immigration status, government identification numbers, financial information, precise location information, criminal history, or other highly personal details.
If you voluntarily submit sensitive information, you consent to our processing of that information as reasonably necessary to create, deliver, support, and maintain records relating to your order.
- Location Data and Metadata
Photos and files may contain hidden metadata, including location data, device information, timestamps, or other embedded information.
Before sending photos or files, you should remove any metadata you do not want shared or processed.
My Lyra Song is not responsible for metadata contained in files you submit.
- Prohibited Materials
You may not submit materials that are:
a. unlawful;
b. defamatory;
c. abusive;
d. threatening;
e. harassing;
f. hateful;
g. discriminatory;
h. sexually explicit;
i. exploitative;
j. invasive of privacy;
k. infringing;
l. deceptive;
m. impersonating another person;
n. encouraging self-harm or harm to others;
o. involving non-consensual intimate content;
p. involving exploitation or sexualization of minors;
q. intended to stalk, shame, blackmail, manipulate, threaten, or embarrass another person;
r. violating a court order, restraining order, confidentiality obligation, contract, platform rule, or law.
We may reject, remove, delete, or refuse to use any materials at our sole discretion.
- Copyrighted and Third-Party Materials
Do not submit copyrighted, trademarked, licensed, or third-party materials unless you have the legal right to do so.
This includes, but is not limited to:
a. professional photographs;
b. album covers;
c. movie images;
d. celebrity images;
e. screenshots;
f. social media content;
g. stock photos;
h. artwork;
i. logos;
j. poems;
k. song lyrics;
l. recordings;
m. written works;
n. brand assets;
o. any content owned by another person or entity.
You are solely responsible for obtaining all permissions and licenses required for any third-party materials you submit.
- Names, Likenesses, and Publicity Rights
You are responsible for obtaining permission to submit any person’s name, likeness, image, voice, story, private facts, or identifying details.
This includes recipients, family members, romantic partners, friends, children, parents, public figures, deceased persons, and any other identifiable individuals.
You may not submit another person’s name, likeness, or personal information in a way that violates their privacy, publicity rights, contractual rights, or legal rights.
- No Obligation to Use Submitted Materials
Submitting materials does not guarantee that we will use all or any of them.
We may choose not to use specific names, photos, stories, images, details, wording, instructions, or references if we believe they are unsuitable, unclear, low quality, unlawful, risky, inappropriate, technically unusable, or inconsistent with the Service.
We may edit, adapt, summarize, omit, modify, or reinterpret submitted materials as part of the creative process.
- Quality of Submitted Materials
You are responsible for submitting clear, accurate, complete, and usable materials.
Poor-quality photos, blurry images, incomplete stories, unclear names, spelling errors, pronunciation issues, vague instructions, late submissions, or incorrect details may affect the final deliverable.
No refund, cancellation, credit, exchange, or remake will be provided because of low-quality, inaccurate, incomplete, unclear, late, or unsuitable materials submitted by the customer, except where required by law.
- File Delivery and Upload Methods
Depending on the order, materials may be submitted through an order form, email, upload link, file transfer service, cloud storage link, or another approved method.
You should not send unnecessary files, excessive file sizes, passwords, financial information, government identification, or highly sensitive personal information unless specifically requested.
We may reject files that are too large, corrupted, unsafe, unsupported, password-protected, suspicious, or technically unsuitable.
- Security and Transmission Risk
Digital file transmission always involves risk.
Although we use reasonable measures to receive, store, and process submitted materials, no website, email system, upload tool, storage system, file transfer service, or internet transmission can be guaranteed completely secure.
You submit materials at your own risk.
Do not submit materials that you are not comfortable transmitting electronically for the purpose of creating your order.
- Third-Party Tools and Service Providers
To provide the Service, My Lyra Song may use third-party tools and service providers, including website hosting, email, payment processing, form tools, file storage, file transfer, audio tools, editing tools, software-assisted creative and production tools, and related technical services.
Materials you submit may be processed by these tools or providers as reasonably necessary to create, deliver, support, store, protect, or maintain records relating to your order.
- Human-Directed Creative and Production Process
Orders are created through a human-directed creative and production process.
That process may include software-assisted creative tools, digital production tools, editing tools, audio production methods, lyric development, arrangement, mixing, mastering, video preparation, and other production steps.
By submitting materials, you authorize us to process those materials through the tools and workflows reasonably necessary to provide the Service.
- No Public Posting Without Permission
We will not intentionally publish your submitted photos, full personal story, private recipient information, or identifiable order details publicly without permission.
However, we may use non-identifying, anonymized, or generalized information internally for quality control, service improvement, workflow development, support, recordkeeping, and business analysis.
We may also use general themes, styles, occasions, workflows, and creative approaches in future work, provided that we do not intentionally disclose your private submitted details or identifiable personal information without permission.
- Customer Indemnification
You agree to defend, indemnify, and hold harmless My Lyra Song and its owners, operators, contractors, vendors, service providers, and affiliates from and against any claims, demands, losses, liabilities, damages, judgments, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
a. materials you submit;
b. your lack of rights, permissions, releases, or consents;
c. claims by recipients or identifiable persons referenced in your order;
d. copyright, trademark, privacy, publicity, confidentiality, or contract claims;
e. claims involving minors;
f. claims involving photos, images, likenesses, stories, names, or private information;
g. your breach of this Upload Policy or the Terms of Service;
h. your violation of any law or third-party right.
- Refusal, Removal, and Deletion
We may refuse, remove, delete, or decline to use any submitted materials at our sole discretion.
We may also cancel or refuse an order if the materials appear unlawful, infringing, unsafe, abusive, exploitative, inappropriate, or inconsistent with our policies.
Refusal to use specific materials does not create a right to a refund, cancellation, credit, exchange, or remake, except where required by law.
- Retention of Submitted Materials
We may retain submitted materials for as long as reasonably necessary to provide the Service, complete orders, maintain records, resolve disputes, enforce agreements, prevent fraud or abuse, comply with legal obligations, and protect our rights.
We may delete, archive, anonymize, or de-identify materials when they are no longer reasonably needed.
- No Return of Submitted Materials
We are not obligated to return, preserve, archive, or maintain copies of submitted materials.
You should keep your own copies of any photos, files, stories, instructions, or other materials you submit.
- Relationship to Other Policies
This Upload Policy is incorporated into and forms part of our Terms of Service.
If there is a conflict between this Upload Policy and another policy, the Terms of Service will control unless this Upload Policy provides a more specific rule about submitted materials.
- Changes to This Upload Policy
We may update this Upload Policy from time to time.
The updated version will be posted on the website with a revised effective date.
Your continued use of the Service after an updated Upload Policy is posted means you accept the updated Upload Policy.
